Terms of Use

1. Introduction
Thank you for using MathQuizily. These Terms of Use, including the Privacy Policy, have been established by MathQuizily ("MathQuizily" or "we / us / our"). The Terms of Use apply to you as a private person or legal person ("Customer" or "you / your / yours") who has registered as a user on MathQuizily's internet service and/or in any of MathQuizily's applications, or entered into a separate subscription agreement on the use of MathQuizily's applications. These Terms of Use, including the Privacy Policy and any separate subscription agreement, together constitute the agreement (the "Agreement") concluded between the Customer and MathQuizily.
2. Service and Payment
2.1 MathQuizily Subscription
MathQuizily offers paid subscription plans that grant access to the Service. The specific features and pricing of each plan are described on the MathQuizily website. MathQuizily reserves the right to modify, adjust, or discontinue subscription plans at any time. Changes to pricing or plan features will be communicated to existing subscribers in advance.
2.2 Trial Subscription
From time to time, we, or others on our behalf, may offer trial versions of paid subscriptions for a specified period of time, without any requirement for payment or at a reduced price (a "Trial Subscription"). MathQuizily reserves the right to withdraw or modify a Trial Subscription at any time without notice and without liability, to the greatest extent permitted by law.
Important notice regarding Trial Subscriptions:
For some Trial Subscriptions, we may require you to submit your payment details to start the trial. By submitting your payment details in connection with a Trial Subscription, you agree that we may automatically begin charging you for the applicable paid subscription on the first day after the trial period expires. If you do not wish to be charged, you must cancel your subscription through your MathQuizily account page before the Trial Subscription expires. Paid subscriptions cannot be canceled before the expiry of the period you have already paid for.
3. Licensing and Your User Rights
3.1 Intellectual Property Rights
The Service and all intellectual property rights are the property of MathQuizily and/or MathQuizily's licensors. The Software and Content are licensed, and not sold, to you, and MathQuizily and its licensors retain ownership of all copies of MathQuizily software and Content even after installation on your personal computers, mobile phones, or tablets.
3.2 License Grant
MathQuizily hereby grants a non-exclusive right for you to use the Service during the term of the Agreement on the terms set forth in this Agreement and with the rights and restrictions set forth in your subscription plan. The license is granted to a certain named person, or to a particular school, as agreed in a separate subscription agreement or upon Customer's registration. Specific conditions for private persons and legal persons:
Private Person:
Subscriptions are personal and the user receives an individual license in connection with the registration and acceptance of these terms.
Legal Person:
Schools can conclude an agreement and obtain a school license for all students at the school. The school is obliged to ensure compliance with this Agreement by its users.
3.3 User Content
You as a user are solely responsible for all User Content that you may post. You retain ownership and any intellectual property rights of User Content. In connection with the conclusion of the Agreement, MathQuizily has been granted the right to use all feedback ("User Content") and obtained an unlimited, non-exclusive, sublicensable license. This license grants MathQuizily the right to use User Content in the further development of the Service, marketing, and modification of User Content. You as a user agree that this license will remain in effect in case of termination of the Agreement, regardless of the reason for such termination.
4. Agreement Term, Termination and Suspension
4.1 Term
The Agreement is valid until the user terminates the Agreement or MathQuizily does so. The Agreement can be terminated without reason by both the user and MathQuizily. The Agreement will expire when your subscription has expired or upon termination by either party.
4.2 Termination in Case of Breach of Contract
A user who violates the Agreement will lose their license to use the Service with immediate effect. The user accepts, confirms, and understands that they may be obliged to compensate MathQuizily for any damage that may result from the breach of contract. For example, if the user violates the license terms or in any way gives unauthorized access to the Service.
4.3 Temporary Suspension of the Service
MathQuizily has the right to temporarily suspend the Service for maintenance if required. MathQuizily also has the right to suspend access to the Service with immediate effect in the event of non-payment.
4.4 No Compensation
When the user terminates the Agreement or is terminated in the event of a breach of contract, MathQuizily is not required to refund any amounts that you have already paid, except when changing the Terms of Use or the Privacy Policy, in accordance with applicable law.
5. User Responsibility
The user is responsible for choosing a secure password for the Service in connection with registration. Credentials such as usernames and passwords must be stored in such a way that unauthorized persons cannot access them. MathQuizily has the right to issue the user a new password if we suspect that the user's account has been compromised by an unauthorized party. The user does not have the right to transfer their account to anyone else under the Agreement.
6. MathQuizily's Responsibility and Limitation of Liability
MathQuizily has the right to offer a license for the Service. MathQuizily is not responsible for any bugs that may occur in the software. MathQuizily is not responsible for any errors or omissions in the content. MathQuizily is not responsible for any damage that may occur when using the Service or if the Service becomes inaccessible, e.g., when the Service is temporarily down or affected by disruptions.
7. Changed Terms of Use
MathQuizily, at its sole discretion, may make changes to the Terms of Use. When we make significant changes to the Terms of Use, we will send you a clear notification based on what is appropriate with respect to the circumstances, e.g., by displaying a prominent notice in the Service or by emailing the user at least 14 days prior. The user has one week to review the new Terms of Use. If you no longer wish to use the Service under the new terms, please contact us at info@mathquizily.com to terminate the Service.
8. Note regarding AI-generated content
MathQuizily uses artificial intelligence to assist in the creation of math problems and tests. The generated content serves as a resource for teachers, parents, and students. The final responsibility for reviewing, adapting, and using the content lies with the user. Teachers should review all problems before using them in class.
9. Age Requirements and Parental Consent
MathQuizily is intended for use by teachers, parents, and students. If the user is under the age of 18, consent from a parent or legal guardian is required before using the Service. By accepting this Agreement, the user confirms that parental or guardian consent has been obtained where required. MathQuizily reserves the right to contact the parent or legal guardian to verify that consent has been given.
10. Acceptable Use and Prohibited Conduct
When using the Service, you agree not to:
- Share, resell, or redistribute generated content for commercial purposes without MathQuizily's prior written consent.
- Share your account credentials with others or allow multiple users to access the Service through a single account (unless covered by a school license).
- Use automated tools, bots, scrapers, or similar technologies to access or extract data from the Service.
- Attempt to reverse-engineer, decompile, or otherwise derive the source code of the Service or its AI models.
- Use the Service in any way that violates applicable laws or regulations.
- Interfere with or disrupt the integrity or performance of the Service.
- Misrepresent AI-generated content as being created without AI assistance where disclosure is required by applicable regulations.
MathQuizily reserves the right to suspend or terminate access to the Service for any user who violates these rules.
11. Data Processing Agreement (DPA)
For school customers and educational institutions that require a Data Processing Agreement (DPA) under the GDPR or other applicable data protection legislation, MathQuizily offers a separate DPA upon request. The DPA outlines the responsibilities and obligations of both parties regarding the processing of personal data in connection with the use of the Service.

12. Governing Law and Jurisdiction
This Agreement shall be governed by and construed in accordance with the laws of Sweden. Any disputes arising out of or in connection with this Agreement shall be settled by the competent courts in Sweden.
